SUBJECT: # 17980: Neighbor problem

What would youse guys do if a big limb from a neighbors tree broke over and was laying in your yard? It's still attached to the tree so I put it back over his side of the fence but if it breaks loose it could fall and bust the fence. It's been 3 weeks and it doesn't look like he has any plans?

We haven't got along that well as he likes to smolder leaves all day and leave it burning overnight while he sleeps. Last week, the wife saw him flip a cigarette butt out on my yard as he drove by. You know the guy.

Anyways, how do I broach the subject?

    Hey, I go through a lot of trouble and time whenever you decide to discard your perch carcasses that you toss over the fence after you clean them. Why couldn't you just pick up the branch and elimate having to possibly deal with it again with property damage?

    And by the way, if I have to deal with smelling your bong all night than you can deal with my smoldering leaves. I threw that cigarette butt in your yard because your bong water killed my Irises!

    If you warn him about the problem in writing then his insurance is responsible for the limb(of course there is no way to find out who his insurance is with unless he tells you).

    If the limb falls without notifying him in writing of the problem, your insurance will have to pay for the fence and most people have between a $250-500 deductible.(also take a picture so you have proof.

    Sounds like a GREAT neighbor!!

    You probably haven't talked to him about it I'm assuming. If you're worried about the fence and it's been three weeks I think I would just cut down the part that might fall on the fence. Do you have any laws there against burning outside? I thought there were problems with fires down there but maybe not anymore but I would think they wouldn't let you burn outside.

    Only I'd call my insurance company and explain the situation to them. Ask them if they have any advice on how to handle it. They may go to work to straighten out the problem before it turns into a costly problem.

    most likely your insurance company can't/won't do anything until the limb falls.

    I have dealt many times with customer's who have dead trees in their neighbor's yard that the neighbor's won't deal with. These are trees that endanger their house and lives. I have found that there is not much you can do. Sometimes the township can get invloved.

    ....you can probably go down to the county clerk or registry of deeds--whatever they call it down there---and see if the guy's insurance company is listed on the copy of the mortgage on file. Banks don't cut the mortgage check unless there's a policy in place, and almost all of them include insurance and taxes in the monthly payment. When a borrower switches coverage, they usually file another copy of the mortgage.

    even if you guys dont get along too good. Just go over and talk to him about it and try to work out a solution to the problem. You've got to live next to this guy so you all might as well try to get along in someway. But if the dudes a real butthead ,go with what the others have said.

    Friction in the hood is something you dont need.

    but I figured I'd get in trouble.

    I was pretty worked up about it and was gonna call him out and talk about it the other day. I got out of the car as he was walking up and was ready to get into it when he told me about the car breakins two nights previous while I was out of town. Some crack heads went through our neighborhood and ripped off CD players and CBs out of unlocked pickup trucks. I was ready to be a jerk and he was coming over to warn me about leaving stuff in my boat.

    Guess I'll just wait and see how it comes out...Thanks for the advice folks.

    Packman - We do have burn restrictions during drought periods but lately we've been getting some rain.

    cant they. I lived in the neighborhood for 13 years and had never held a conversation with several people that lived around me. That sucks! But to have neighbors that will look after your stuff when your not home is big plus in my book. I really lucked out where we live now, GOOD PEOPLE.

    You may not always see eye to eye on things but compromise is a step in the right direction. JMO

    Sounds like this guy may not be worried about the tree...because he see's no concern from you. Also, he must not be as bad of a neighbor as you think, based on he told you about the thefts.

    I would casually blindside him one day with the question:

    So when are WE gonna clean up that ole down limb of yours?

    plenty of big oak trees that are threatening his fence. We have an agreement that if a limb cracks (his or mine) the fence we both pay to replace that section. This way we don't pay a tree trimmer for something nature is going to take care of anyways. With all the old oaks in our yards we would go broke.
